Great question! Here is the answer.
It doesn’t matter if the person who has died (the deceased) passed away having a will or not. In Minnesota, if you die and have real estate titled in the name of the deceased only, or in the names of more than one deceased individuals, you may need a probate. Also, if the deceased has a bank or investment account, in their name only and without a pay-on-death beneficiary, and that account has a balance of $75,000 or more, a probate is needed to transfer those funds to beneficiaries of the deceased.
There are many other situations with assets from an estate that will need to be probated. If you have questions on estate planning or assets that may need a probate, please reach out to us. We are here to answer your questions and guide you through the process after a loss of a family member or loved one.
