When Do I Need to Probate an Estate in Minnesota?

Great question!  Here is the answer. 

It doesn’t matter if the person who has died (the deceased) passed away having a will or not.  In Minnesota, if you die and have real estate titled in the name of the deceased only, or in the names of more than one deceased individuals, you may need a probate.  Also, if the deceased has a bank or investment account, in their name only and without a pay-on-death beneficiary, and that account has a balance of $75,000 or more, a probate is needed to transfer those funds to beneficiaries of the deceased.
